This Web site is provided by TruKolors, Inc “TruKolors”. By accessing or using this Site you agree to be bound by these Terms of Use and to any additional guidelines, restrictions, or rules that may be posted in connection with specific sections or services of this Site. Although you may bypass this Agreement, your use of this Site still binds you to these Terms and Conditions. TruKolors reserves the right to make changes to this Site and to these Terms of Use at any time without prior notice. You should review these Terms of Use each time you access this Site.
Payment
All prices and amounts shown on this Site are in U.S. Dollars (USD), unless otherwise noted. If a User submits a request on the Site to purchase printing products, design services or other services, the User agrees that all charges, taxes and shipping/handling fees will automatically be charged to the credit card or paid by User with an approved payment method. Such amounts will be posted on this Site. After a print job has been sent to TruKolors’s prepress department, the customer is responsible for paying the entire amount of that print job along with applicable taxes and shipping/handling fees, unless otherwise noted. Please note that no work will proceed on any print job in your order until full payment is received by TruKolors.
Sales Tax
TruKolors is required to collect s(7%) sales tax on purchases shipped to Florida. If a customer is tax exempt, the exemption certificate must be sent or faxed to us. Tax is calculated based on the printing and finishing product subtotal. If tax was charged on your order and you would like to claim tax-exempt status, you can request an adjustment for the amount of sales tax charged by sending in documentation of your tax-exempt status.
Quotations/Estimates
Prices posted on this website are subject to change without notice. Written estimates are good for 30 days. An estimate not accepted within 30 days may be changed. Quotations are based on the accuracy of the specifications provided. TruKolors can requote a job at the time of submission if the art does not conform to the information on which the original estimate was based. Orders placed with TruKolors are to the client's knowledge correct, and there are no conditions or agreements relating to the order which are not written or accompanying said order.
Refund Policy
All sales are final. If there is an error that is verifiably due to TruKolors, Inc, we will re-print the order at our cost 100% and match your selected shipping method. If is the customer’s fault, they will be 100% responsibility. Customer must notify TruKolors, Inc. within 6 business days of order acceptance to notify any defects discovered in the ordered product or the claim will be denied. In order to receive replacement Customer must return 100% of the received product within 15 days (at their own expense) from the time when the ordered product delivery was taken.
All charges related to expedite printing (Rush Printing or Shipping) are NOT REFUNDABLE, including for those orders that are returned for any reason.
Customer Content
You understand that all information, data, text, photographs, graphics, messages or other materials ("Content") are the sole responsibility of the person from which such Content originated. This means that you, and not TruKolors, Inc., are entirely responsible for all Content that you use from TruKolors, Inc. Gallery or send, upload, post or transmit via the Service. Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. You agree to not use the Service to send, upload, post or otherwise transmit any Content that contains (i) child pornography or anything indecent, obscene, lewd, lascivious, filthy or vile; (ii) a threat to kidnap or injure a person, a threat to injure the personal property or reputation of another person, a threat to accuse any person of a crime, a threat to inform another that a person has violated any law of the United States, or a threat of blackmail; (iii) any matter advocating or urging treason, insurrection, or forcible resistance to any law of the United States; (iv) any defamatory remarks directed at any other person or company; or (v) any content that infringes the intellectual property rights or other proprietary rights of TruKolors, Inc. or any third party does not control posted by Customers and does not guarantee the accuracy, intergrity or quality of the Content Under no circumstances will TruKolors, Inc. be liable to you in any way for any Content you may be exposed to that you may find offensive, indecent or objectionable. Products and services, are provided for your personal use only. You agree to abide by these terms of service and not to use these products and services or related messages for any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation. You acknowledge that TruKolors, Inc. Inc. does not pre-screen Content, but that TruKolors, Inc. and its affiliates shall have the right (but not the obligation) in their sole discretion to remove any Content that violates the terms of service or may otherwise be objectionable. You further acknowledge and agree that TruKolors, Inc. may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the terms of service; (c) respond to claims that the Content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of TruKolors, Inc., its users and the public.
Turnaround Time
Next business day turnaround: All jobs in by 10:00 AM will be ready the next day by 6:30 PM, problem jobs or jobs that require proofs won't be considered as next business day, turnaround begins when we receive proof approval. Business days are Monday through Friday. Holidays, Saturdays and Sundays do not count when calculating turnaround. For printing jobs that do not have complete digital source files provided, printing turnaround begins when we have your print-ready file(s) for your print job, not from when the order is first submitted. Our process takes two to three business days for production excluding shipping. Factors such as mechanical breakdowns and shipping company practices are out of our control and we cannot be held responsible if they affect a shipment from arriving "on time". Orders submitted Saturday or Sunday will be processed on Monday.
Please note that TruKolors offices are closed Saturdays, Sundays and Holidays. As a result, these days are not considered when calculating printing turnaround time. In addition, printing turnaround time does not include shipping transit time, and you should allow additional business days for delivery based on the shipping method you selected. Arrival dates are calculated by adding the printing turnaround time to the shipping transit time. Business days are Monday through Friday. Holidays, Saturdays and Sundays do not count when calculating turnaround.
Art Work
Once a job has been sent to press, the process is final and changes cannot be made. Our prepress department checks most artwork files before printing, but you are still 100% responsible for the accuracy of your print-ready artwork files, and we encourage you to proofread all files carefully before submitting to TruKolors. Please proofread all text, make sure All artwork or designs and images must be provided in CMYK format. TruKolors, Inc. is not responsible for any color shift that occurs in conversions from RGB to CMYK or PMS Pantone colors to CMYK color modes. All artwork, designs and images must be provided in minimum of 300 DPI and CMYK color mode. TruKolors, Inc. is not responsible for images printed as fuzzy, distorted or pixilated due to customer provided artwork.
TruKolors, Inc. is not responsible for any color shift in converted photographs (RGB images) with black, near black, or gray tones. Color shifts from a perceived black or gray must be addressed prior to file submission. Proofs do not guarantee black, near black or gray final output. Under these Terms and Conditions, you agree that you will NOT upload any artwork files consisting of the following material: any material that could give rise to any civil or criminal liability under applicable law; and any material that could infringe rights of privacy, publicity, copyrights or other intellectual property rights without the permission of the owner of these rights and the persons who are shown in the material if applicable.
Order Approval
Please review your order prior to submitting. We do not accept changes to orders that have been placed. Customer is fully responsible for final proof and layout approval prior to the printing process.
TruKolors, Inc. is NOT LIABLE for errors in a final product caused by any of the following reasons:
Misspelling, Graphics, Bleeds, Grammar, Damage Fonts, Punctuation, Wrong cuts, Incorrect or Missing Folds, Die Lines, Crop Marks, Transparency, Overprint, Finished Product Size. We DO NOT make any changes on customer files.
Order Cancellation
You can cancel your order prior to Approval. Our Customer Service Team will inform you of any cancellation charges depending on the stage of the order. Please allow up to 10 business days for the monies to be credited to your account. Orders may not be cancelled or refunded once they have gone into production or any process thereafter. Absolutely no refunds will be issued once an order has been Plated or any process thereafter, including but not limited to Printing, Coating, and / or Finishing. Once the order has been placed successfully, No Refunds are issued for Creative Services. TruKolors, Inc. is not responsible for any duplicated orders that are placed on our web site due to the customer mistake.
Copyrighted Materials
You are solely responsible for your use of Content in combination with any other images, graphics, text or other materials you incorporate into your Products. You agree that you will not include any text, image, design, trademark, service mark, or any copyrighted work of any third party in your Products unless you have obtained the appropriate authorizations from the owners. You warrant that your Products do not infringe upon any rights of any third party, including copyright, trademark, right of publicity or privacy, and will not libel or defame any third party, and that you have all required rights or permissions necessary to incorporate third party material into your Products. By placing an order on this Site, you warrant that you have all necessary permission, right and authority to place the order and you authorize TruKolors, Inc to print Products on your behalf.
Indemnity
By submitting the above document to TruKolors, Inc. "I agree to the following terms".
I have verified that spelling and content are correct. I am satisfied with the document layout. I understand that my document will print EXACTLY as it appears here, that I cannot make any changes once my order is placed and that I assume all responsibility for typographical errors.
Electronic Manuscripts/Images
It is the client's responsibility to maintain a copy of the original computer files and artwork. TruKolors is not responsible for accidental loss or damage to media supplied by the client or for errors on supplied artwork furnished by the client. Until TruKolors can evaluate digital input, no claims or promises are made about our ability to work with jobs submitted in digital format, and no liability is assumed for problems that may arise. Any additional translating, editing, or programming needed to utilize client-supplied files will be charged at our current rates. TruKolors does not save your work for longer than it takes to produce the final product.
Alterations/Corrections
Client alterations must be specified in writing and must include all corrections or changes from the original specifications. Such work will be charged at our current rates.
Complaints
Claims for defects, damages, or shortages must be made by the client in writing within 48 hours of receipt of your final printing job. If no such claim is made, TruKolors and the client will understand that the job has been accepted. By accepting the job, the client acknowledges that TruKolors performance has fully satisfied all terms, conditions and specifications. You must inspect the product upon receipt. If any of the product is used then a claim is null and void. Should your job contain manufacturing errors and/or defects (as determined by TruKolors), TruKolors would rerun your job at no charge.
All materials we create in producing your printed product are the property of TruKolors. Although these materials will NOT be sold or given to any other party, we reserve the right to distribute free samples of your printed product. Please note that your printed product or images used for your printed product will not be used in any national advertising without your prior written consent.
Color Proof
TruKolors, Inc. is not liable for color matching or ink density on screen proofs approved by the customers. Screen proofs will predict design layout, text accuracy, image proportion and placement, but not color or density. Electronic proofs do not show transparency and over print issues neither do they show color change from RGB to CMYK. Application of UV Coating may effect or change the appearance of the printed colors. TruKolors, Inc. is not liable for the final color appearance of a UV product/s. TruKolors, Inc. reserves the right to change the paper quality and/or type at anytime, without notifying its customers. Please note that we accept no responsibility for color variations between submitted print-ready images and the actual artwork or product they represent. Because of differences in equipment, paper, inks, and other conditions between color proofing and production pressroom operations, a "pleasing color" variation between color proofs and the completed job [as determined by generally accepted trade technical methods] is to be expected. When such a variation occurs, it will be considered acceptable performance. However, be advised that TruKolors, Inc does not guarantee color matching.
If your job is color critical, you must request a color proof which is an additional service not included in the prices advertised on this website. If you have purchased our color proof service and received prints that do not resemble the color and/or positioning on the final proof – we will reprint the job at no charge. We reserve the right of final judgment in matching the color proof to the prints. Please note that TruKolors cannot guarantee color reproduction for your print-ready files if you: (a) did not request a hardcopy proof; or (b) purchased a product that does not feature a hardcopy proof option.
Acceptable File Types
Files submitted must be of either TIFF, JPEG, PDF or EPS format, all layers flattened, and fonts converted to outlines.
Shipping
TruKolors, Inc assumes no responsibility for delays caused by delivery carriers or any damages resulting from the failure to receive a job on time. Your order may arrive late due to unforeseen delays in delivery service, the breakdown of equipment, illness, etc. We are unable to combine orders for shipment. Each order submitted is considered an individual shipment. In case of delay caused by technical difficulty, rush charges/fees will be refunded or waived where applicable. However, technical difficulty will not be the grounds for order cancellation. Due to our quick turnaround, shipping methods selected on our online ordering page are final and cannot be changed once the order is submitted. We will not upgrade or change the shipping method that was selected on our online ordering page. Also, we will not use any other form of shipping that is not one of our pre-determined shipping options. We will not use client's account numbers, regardless of the carrier for the shipping of orders.
TruKolors, Inc. shipment and delivery dates and prices calculated based upon estimates provided by our suppliers and TruKolors reserves the right to make changes to this Prices at any time without prior notice.
TruKolors, Inc. can only use its own shipping account and will not use customer provided account numbers for any couriers. Orders must be shipped at whole quantities and may not be split up. Please note that we don't ship to P.O. Boxes. TruKolors, Inc. is not responsible for 3rd party shipping errors, omissions or damaged shipments.
Customer Supplied Incorrect Address When a package is not delivered due to an error made by the customer in submitting the proper shipping address,TruKolors, Inc. will reship the package with corrected address and charge an additional shipping fee for the shipment.
Transfer of Tittle
You understand the shipping terms are FOB shipping point, which means ownership transfers once we deliver any printed products to TruKolors, Inc.'s shipping carrier.
Printing Over/Under Runs
TruKolors will always print the desired quantity or more than the desired quantity. As far as final size, this may vary slightly. Normal printing standards are about 1/8th of an inch. This means if you submit a 4 x 6 the final size can really be as small as 3 7/8 x 5 7/8 (3.875 x 5.875). The generally accepted trade practice is plus or minus 5%. All packages are weighted before departure and meet our weight specifications for the amount packaged. TruKolors, Inc. reserves the right to 5% over / under run.
Right to Subcontract
TruKolors shall have the right to assign any portion of the work required to another contractor.
Gang Run
Because of the nature of gang run style printing TruKolors shall not be held responsible for the following : variation in color, cutting variations, cutting issues, size discrepancies (over/under), and etc. Customer acknowledges that they are receiving gang run style printing at a substantial price discount and expedited delivery times and thus said printing will not be held to the same standard as traditional offset lithography nor generally accepted printing standards. While every effort will be made to satisfy our customer's needs, requests for reprints or credits based on quality issues will not be recognized.
Third Parties
If you use this Site to submit Requests for or on behalf of a third party ("Third Party"), you are responsible for any error in the accuracy of information provided in connection with such use. You must inform the Third Party of all Terms and Conditions applicable to all products or services acquired through this Site. Each User using this Site for, or on behalf, of a Third Party agrees to indemnify and hold each Covered Party harmless from, and against, any and all liabilities, losses, damages, suits and claims (including the costs of defense), relating to the Third Party's or the User's failure to fulfill any of its obligations as described (above). The User is directly responsible for any Request submitted, including related fees, charges and performance obligations.
Liability
TruKolors’s liability shall be limited to the stated selling price to the customer of any defective goods, and shall in no event include special, consequential, incidental, indirect or similar damages, including without limitation, lost profits. TruKolors warrants that every product manufactured by it meets industry standard for such product and is free of any material defect in workmanship. IT IS EXPRESSLY AGREED THAT THIS WARRANTY IS IN LIEU OF ALL WARRANTIES OF FITNESS FOR PARTICULAR USE AND MERCHANTABILITY. TruKolors makes no other warranty and no actions or words of TruKolors or its officers, employees or agents shall constitute a warranty. In no event shall TruKolors, Inc. or its licensors, suppliers, or vendors, their officers, directors, employees, or agents, be liable for any special, incidental, indirect, or consequential damages of any kind, or for any damages whatsoever resulting from loss of use, data or profits, whether or not TruKolors, Inc. has been advised of possibility of the damage, arising out of or in connection with the use or performance of the site or of failure to provide services that you order from TruKolors, Inc. or its affiliates, including without limitation, damages arising from mistake, omission, virus, delay, or interruption of service. In no event shall TruKolors, Inc. be liable or responsible for any damages or consequences arising from or related to your inappropriate or unauthorized use of the site or its content.
Indemnification
You agree that you shall indemnify and defend TruKolors, Inc. and all parties from whom TruKolors, Inc. has licensed portions of Content, and their directors, officers, and employees, against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses arising out of or related to (i) your breach of these Terms of Use or (ii) any suit, claim, or demand arising from or relating to any text, photograph, image, graphic or other material you incorporated into Products.
Governing Law
TruKolors, Inc. is based in Miami, Florida. Any legal action or proceeding relating to or arising from your access to or use of this Site shall be instituted in in Miami, Florida. You agree to submit to the jurisdiction of in Miami, Florida. courts and agree that venue in these courts is proper in any such legal action or proceeding.

Electronic Manuscripts/Images
It is the client's responsibility to maintain a copy of the original computer files and artwork. TruKolors is not responsible for accidental loss or damage to media supplied by the client or for errors on supplied artwork furnished by the client. Until TruKolors can evaluate digital input, no claims or promises are made about our ability to work with jobs submitted in digital format, and no liability is assumed for problems that may arise. Any additional translating, editing, or programming needed to utilize client-supplied files will be charged at our current rates. TruKolors does not save your work for longer than it takes to produce the final product.
Alterations/Corrections
Client alterations must be specified in writing and must include all corrections or changes from the original specifications. Such work will be charged at our current rates.
Complaints
Claims for defects, damages, or shortages must be made by the client in writing within 48 hours of receipt of your final printing job. If no such claim is made, TruKolors and the client will understand that the job has been accepted. By accepting the job, the client acknowledges that TruKolors performance has fully satisfied all terms, conditions and specifications. You must inspect the product upon receipt. If any of the product is used then a claim is null and void. Should your job contain manufacturing errors and/or defects (as determined by TruKolors), TruKolors would rerun your job at no charge.
All materials we create in producing your printed product are the property of TruKolors. Although these materials will NOT be sold or given to any other party, we reserve the right to distribute free samples of your printed product. Please note that your printed product or images used for your printed product will not be used in any national advertising without your prior written consent.
Color Proof
TruKolors, Inc. is not liable for color matching or ink density on screen proofs approved by the customers. Screen proofs will predict design layout, text accuracy, image proportion and placement, but not color or density. Electronic proofs do not show transparency and over print issues neither do they show color change from RGB to CMYK. Application of UV Coating may effect or change the appearance of the printed colors. TruKolors, Inc. is not liable for the final color appearance of a UV product/s. TruKolors, Inc. reserves the right to change the paper quality and/or type at anytime, without notifying its customers. Please note that we accept no responsibility for color variations between submitted print-ready images and the actual artwork or product they represent. Because of differences in equipment, paper, inks, and other conditions between color proofing and production pressroom operations, a "pleasing color" variation between color proofs and the completed job [as determined by generally accepted trade technical methods] is to be expected. When such a variation occurs, it will be considered acceptable performance. However, be advised that TruKolors, Inc does not guarantee color matching.
If your job is color critical, you must request a color proof which is an additional service not included in the prices advertised on this website. If you have purchased our color proof service and received prints that do not resemble the color and/or positioning on the final proof – we will reprint the job at no charge. We reserve the right of final judgment in matching the color proof to the prints. Please note that TruKolors cannot guarantee color reproduction for your print-ready files if you: (a) did not request a hardcopy proof; or (b) purchased a product that does not feature a hardcopy proof option.
Acceptable File Types
Files submitted must be of either TIFF, JPEG, PDF or EPS format, all layers flattened, and fonts converted to outlines.
Shipping
TruKolors, Inc assumes no responsibility for delays caused by delivery carriers or any damages resulting from the failure to receive a job on time. Your order may arrive late due to unforeseen delays in delivery service, the breakdown of equipment, illness, etc. We are unable to combine orders for shipment. Each order submitted is considered an individual shipment. In case of delay caused by technical difficulty, rush charges/fees will be refunded or waived where applicable. However, technical difficulty will not be the grounds for order cancellation. Due to our quick turnaround, shipping methods selected on our online ordering page are final and cannot be changed once the order is submitted. We will not upgrade or change the shipping method that was selected on our online ordering page. Also, we will not use any other form of shipping that is not one of our pre-determined shipping options. We will not use client's account numbers, regardless of the carrier for the shipping of orders.
TruKolors, Inc. shipment and delivery dates and prices calculated based upon estimates provided by our suppliers and TruKolors reserves the right to make changes to this Prices at any time without prior notice.
TruKolors, Inc. can only use its own shipping account and will not use customer provided account numbers for any couriers. Orders must be shipped at whole quantities and may not be split up. Please note that we don't ship to P.O. Boxes. TruKolors, Inc. is not responsible for 3rd party shipping errors, omissions or damaged shipments.
Customer Supplied Incorrect Address When a package is not delivered due to an error made by the customer in submitting the proper shipping address,TruKolors, Inc. will reship the package with corrected address and charge an additional shipping fee for the shipment.
Transfer of Tittle
You understand the shipping terms are FOB shipping point, which means ownership transfers once we deliver any printed products to TruKolors, Inc.'s shipping carrier.
Printing Over/Under Runs
TruKolors will always print the desired quantity or more than the desired quantity. As far as final size, this may vary slightly. Normal printing standards are about 1/8th of an inch. This means if you submit a 4 x 6 the final size can really be as small as 3 7/8 x 5 7/8 (3.875 x 5.875). The generally accepted trade practice is plus or minus 5%. All packages are weighted before departure and meet our weight specifications for the amount packaged. TruKolors, Inc. reserves the right to 5% over / under run.
Right to Subcontract
TruKolors shall have the right to assign any portion of the work required to another contractor.
Gang Run
Because of the nature of gang run style printing TruKolors shall not be held responsible for the following : variation in color, cutting variations, cutting issues, size discrepancies (over/under), and etc. Customer acknowledges that they are receiving gang run style printing at a substantial price discount and expedited delivery times and thus said printing will not be held to the same standard as traditional offset lithography nor generally accepted printing standards. While every effort will be made to satisfy our customer's needs, requests for reprints or credits based on quality issues will not be recognized.
Third Parties
If you use this Site to submit Requests for or on behalf of a third party ("Third Party"), you are responsible for any error in the accuracy of information provided in connection with such use. You must inform the Third Party of all Terms and Conditions applicable to all products or services acquired through this Site. Each User using this Site for, or on behalf, of a Third Party agrees to indemnify and hold each Covered Party harmless from, and against, any and all liabilities, losses, damages, suits and claims (including the costs of defense), relating to the Third Party's or the User's failure to fulfill any of its obligations as described (above). The User is directly responsible for any Request submitted, including related fees, charges and performance obligations.
Liability
TruKolors’s liability shall be limited to the stated selling price to the customer of any defective goods, and shall in no event include special, consequential, incidental, indirect or similar damages, including without limitation, lost profits. TruKolors warrants that every product manufactured by it meets industry standard for such product and is free of any material defect in workmanship. IT IS EXPRESSLY AGREED THAT THIS WARRANTY IS IN LIEU OF ALL WARRANTIES OF FITNESS FOR PARTICULAR USE AND MERCHANTABILITY. TruKolors makes no other warranty and no actions or words of TruKolors or its officers, employees or agents shall constitute a warranty. In no event shall TruKolors, Inc. or its licensors, suppliers, or vendors, their officers, directors, employees, or agents, be liable for any special, incidental, indirect, or consequential damages of any kind, or for any damages whatsoever resulting from loss of use, data or profits, whether or not TruKolors, Inc. has been advised of possibility of the damage, arising out of or in connection with the use or performance of the site or of failure to provide services that you order from TruKolors, Inc. or its affiliates, including without limitation, damages arising from mistake, omission, virus, delay, or interruption of service. In no event shall TruKolors, Inc. be liable or responsible for any damages or consequences arising from or related to your inappropriate or unauthorized use of the site or its content.
Indemnification
You agree that you shall indemnify and defend TruKolors, Inc. and all parties from whom TruKolors, Inc. has licensed portions of Content, and their directors, officers, and employees, against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses arising out of or related to (i) your breach of these Terms of Use or (ii) any suit, claim, or demand arising from or relating to any text, photograph, image, graphic or other material you incorporated into Products.
Governing Law
TruKolors, Inc. is based in Miami, Florida. Any legal action or proceeding relating to or arising from your access to or use of this Site shall be instituted in in Miami, Florida. You agree to submit to the jurisdiction of in Miami, Florida. courts and agree that venue in these courts is proper in any such legal action or proceeding.
